Before opening a business or signing a lease, check whether the actual operation is permitted on the property. A landlord’s agreement, an existing commercial activity or a business registration does not by itself establish lawful land-use rights.

Describe the operation, not just the business name

A quiet consulting practice, a busy salon, a café and a vehicle workshop have different effects and may fall under different scheme definitions. Record the floor area, activities, employees, customers, deliveries, hours, signage and any outdoor areas. Include future expansion you already intend, so the assessment is based on the real brief.

Work out which planning route applies

Position What it means to investigate
Primary right Whether the use is permitted under the zone and complies with its conditions and development rules.
Home occupation or similar provision Whether the scale remains within the scheme’s specific residential-business allowance.
Consent use Whether the defined use is listed for municipal consideration in the zone.
Rezoning or another mechanism Whether a different use or intensity needs an application beyond existing rights.

These routes depend on the municipality and scheme. George, for example, distinguishes specified residential business activities and consent uses, and its house-shop guidance separates planning permission from building and business-licensing requirements. Do not assume a home occupation provision allows any business, or that rezoning is necessary in every case.

Check the constraints that affect viability

  • Existing land-use approvals, approved plans and conditions restricting the use.
  • Required parking, accessible access, manoeuvring and delivery arrangements.
  • Noise, odours, extraction, waste, operating hours and effects on neighbours.
  • Title conditions, servitudes, estate rules and body-corporate requirements.
  • Building suitability, occupancy, fire and health requirements, signage and the relevant licences.

Test the premises before committing

Illustrative example: a proposed consulting practice can use an existing house internally, but the intended staff and visitor numbers create parking demand that the site cannot readily accommodate. Establishing this before the lease is signed allows the operator to change the scale, investigate an application or choose another property. The fact that no building extension is planned does not resolve the use question.

Coordinate the approvals and the agreement

Ask the planner to identify the land-use pathway and supporting work, then involve the architectural professional, engineer or other specialists where needed. Your attorney should advise on lease or purchase conditions and who bears approval and fit-out costs. Obtain written confirmation of the relevant position; an informal conversation is not an approval.

What to send for an initial review

The address and erf number, proposed floor plan, business description, employee and customer numbers, operating hours and available approval records. A useful first assessment should distinguish existing rights, likely applications and the issues that could make the premises unsuitable.
